1. Acceptance of terms & service overview

By downloading, installing, or accessing the Mocle mobile application or visiting www.mocle.co, you agree to be bound by these Terms of Service. Mocle provides a creative pixel art community platform where users can draw artwork, publish creations, participate in galleries, and send image messages.

2. Account eligibility & access security

• Age qualification: you must be at least 18 years of age to create an account or use Mocle.
• Authentication safety: when signing in via Sign in with Apple, you remain fully responsible for protecting your account credentials and for all actions taken under your account. You must notify us immediately of any suspected unauthorized access.

3. User content ownership & licensing

• Ownership retention: you retain full intellectual property rights and ownership of original pixel art and content created and published on Mocle.
• License grant: by posting content publicly or sending image messages within the platform, you grant the Mocle Team a worldwide, non-exclusive, royalty-free license to host, display, reformat, and render your content solely for operating, promoting, and sustaining platform functionality.

4. Prohibitions & community guidelines

You explicitly agree not to submit, upload, or transmit content that:

• Contains obscene, pornographic, sexually explicit, or excessively violent material.
• Promotes hate speech, harassment, bullying, discrimination, or physical harm.
• Infringes upon third-party copyrights, trademarks, or intellectual property rights.
• Distributes malicious code, spam, deceptive links, or unauthorized commercial advertisements.

5. Content moderation & 24-hour review SLA

• Safety features: Mocle incorporates native tools allowing users to block offensive creators and flag inappropriate content or messages.
• 24-hour enforcement pledge: the Mocle Team actively monitors user reports and guarantees to investigate flagged content and execute corrective measures (including content removal or account suspension) within 24 hours of submission.

6. Virtual currency ("Crystals") & in-app purchases

• Nature of virtual items: Mocle may offer virtual tokens known as Crystals, alongside digital canvas tools or decorative badges for purchase. Crystals and virtual items hold no cash value, are non-transferable, non-exchangeable for fiat currency, and do not constitute personal property.
• Finality of sale: all purchases are final and non-refundable, except as required by applicable law or Apple's App Store policies. All transactions are handled exclusively through Apple's App Store billing system.

7. Proprietary intellectual property

The underlying source code, canvas engine, brand assets, UI design, and proprietary graphics comprising Mocle belong exclusively to the Mocle Team. You may not reverse engineer, decompile, duplicate, or extract platform software code without explicit written permission.

8. Apple terms & third-party beneficiary clause

• Acknowledgement: these Terms are executed solely between you and the Mocle Team, not Apple Inc. Apple is not responsible for the app or its content.
• Third-party beneficiary: you acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms. Upon your acceptance, Apple has the legal right to enforce these Terms against you as a third-party beneficiary.

9. Disclaimer of warranties

Mocle is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, express or implied. We do not warrant that platform operations will be uninterrupted, error-free, secure, or free from server outages.

10. Limitation of liability

To the maximum extent permitted by applicable law, the Mocle Team shall not be liable for any indirect, incidental, consequential, or punitive damages — including loss of creative works, loss of data, or operational interruptions — arising out of your use of or inability to use the platform.

11. Termination procedures

• User-initiated deletion: you can terminate your account and agreement at any time within the app by selecting Settings → Delete Account.
• Platform enforcement: we reserve the right to suspend or permanently close your account without prior notice if you violate these Terms or engage in unlawful behavior.

12. Governing law

These Terms shall be governed by and construed under the laws applicable in the developer's operating jurisdiction, without giving effect to conflicts of law principles.

13. Revisions & contact information

We reserve the right to revise these Terms periodically. Updates will be announced on www.mocle.co or within the application. Continued usage of Mocle following modifications signifies acceptance of the revised terms. For legal inquiries, contact service@mocle.co.
